AUCTION FORMAT

Timed Online Auction w/ Staggered Close:
Auction lots will close in a staggered format beginning at the published closing time, approximately 30 to 60 seconds apart.

Bid Sniping Protection Enabled:
If a bid is placed during the final moments of bidding, the closing time for that individual lot will automatically extend approximately 30 to 60 seconds.

Auctioneer reserves the right to postpone, suspend, extend, combine, divide, withdraw, or cancel any lot or the auction in the event of technical difficulties, internet outages, system failures, title issues, settlement agreements, or other circumstances beyond Auctioneer's control.


BUYER'S PREMIUM

A 15% Buyer's Premium applies to all purchases made through the online bidding platform.


SALES TAX

No Sales Tax.


REGISTRATION

A valid credit card is required to register and will remain on file for verification purposes.


PAYMENT

Payment in full is due within twenty-four (24) hours following the auction.

No property may be removed until the invoice has been paid in full.

Auctioneer reserves the right to resell any unpaid lots if payment is not received by 3:00 PM on the day following the auction. Buyer shall remain responsible for all losses, collection costs, resale deficiencies, storage charges, transportation expenses, and reasonable attorney's fees.


FORMS OF PAYMENT

Cash, cashier's check, wire transfer, or credit card (up to $3,000). Credit card payments are subject to a 3% convenience fee.


AS-IS, WHERE-IS

All property is sold AS-IS, WHERE-IS, WITH ALL FAULTS, and without warranty or guarantee of any kind, express or implied.

Descriptions, photographs, measurements, quantities, capacities, model numbers, serial numbers, dimensions, year of manufacture, and condition reports are provided solely as a guide and are subject to errors and omissions.

Buyers are solely responsible for inspecting the property and verifying all information prior to bidding.

Photographs may depict items not included in the lot description.

All sales are final.


REMOVAL

Removal shall be completed within seventy-two (72) hours following the auction unless otherwise announced.

Purchasers shall remove purchased lots in their entirety and leave the removal area in broom-clean condition.

Purchasers shall be responsible for any damage caused during dismantling, loading, or removal operations and shall repair or reimburse Seller for damage to buildings, floors, walls, loading docks, utilities, pavement, landscaping, or other property.

Auctioneer may require certificates of insurance, licensed riggers, electricians, plumbers, engineers, lift plans, or other qualified contractors before designated assets may be removed.

Risk of loss passes to Buyer immediately upon conclusion of the auction.


ALL SALES FINAL

No returns, exchanges, credits, or adjustments will be permitted.

Buyers paying by credit card agree not to initiate chargebacks or payment disputes relating to purchases made under these Terms of Sale.


DISPUTES

Auctioneer's electronic bidding records and audio recordings shall constitute the official record of sale.

If Auctioneer is unable to deliver all or part of a lot, Buyer's sole remedy shall be a refund of monies actually paid for the affected lot.


LIABILITY

All persons attending inspection or removal do so entirely at their own risk and release Seller and Auctioneer from any liability for injury, loss, or property damage.


GOVERNING LAW

These Terms shall be governed by the laws of the State of New Jersey. Registration and bidding constitute acceptance of these Terms of Sale.

Additional terms announced by Auctioneer shall become part of these Terms of Sale.
